Section 1: Promotion

Promotional Period: The Promotion starts at 12.01am AEST on Dec 1 2021 and closes at 11.59pm AEST on Dec 21 2020.
Section 2: Eligibility
Entry Restrictions: Entry is open to residents of Australia who are aged 18 years or over. The Entrant must not be an employee, manager, director of the Promoter, their related companies and agencies, and their immediate families.
Eligible Entrant: An Eligible Entrant is the owner of the TikTok account who posts an entry according to section 3 (Entry to the Promotion).
Section 3: Entry to the Promotion
Entry Method: To enter, Eligible Entrants must during the Promotional Period:
- download and sign into the TikTok mobile application;
- record themselves performing the “Menulog #DeliverItDifferently Challenge” on the TikTok mobile application using the official song “Did Somebody Say” by “Big Twisty”; and
- post their “Menulog #DeliverItDifferently Challenge ” to the TikTok App using hashtag #DeliverItDifferently.
The Promoter will judge all entries to determine winners according to section 4 (Judging).
For the avoidance of doubt, entries may contain more than one person in the video, however, any prizes won will only be awarded to the Eligible Entrant. The Eligible Entrant must also obtain consent of the other people in the video prior to entering.
Maximum entries permitted: Multiple unique entries are permitted, however entrants can only win one (1) prize.
Section 4: Judging
Judging Details: All valid entries will be judged at 12pm AEST on Jan 10 2022 at Level 35, Tower 3/300 Barangaroo Ave, Barangaroo, Sydney, NSW, 2000. This is a game of skill. Chance plays no part in determining the winner. The one (1) most creative, original and suitable entry will be deemed Prize Winner and will be awarded with the Prize. Entries must be an original, independent creation of the Eligible Entrant and free from any third party claims, including copyright or trademark claims. Entries must not: (a) have been published previously; and (b) contain information that is discriminatory, defamatory, or offensive or which infringes any law or regulation.
All decisions are at the discretion of the Promoter and no correspondence will be entered into. The Promoter reserves the right to reject any inappropriate entries or entries that do not enter into the spirit of the competition or entries which otherwise do not comply with these terms and conditions, at its sole discretion.
The Eligible Entrants consent to the Promoter, its related companies and the competition sponsors using comments made on the competition page, including placing such comments on its websites or third party websites for any commercial purpose including future promotional marketing and publicity purposes. Unless expressly requested by the Eligible Entrants to do so we may not acknowledge your authorship when posting comments.

No exchange of Prize: The Prize will be supplied as described in these Terms and Conditions. The Prize can be transferred to another person or entity with approval of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and it does not wish to transfer the Prize, then the Prize will be forfeited;
Taxes: Winners will be responsible for any tax liability associated with a Prize.
If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu.
Section 6: Prize Winners
Prize Winner Notification Major Prize Winners will be notified by Direct Message on their TikTok App account by 5pm AEST on Jan 10 2022.
Prize Winner Publication Details: The Prize Winners’ TikTok name will be published on https://www.menulog.com.au/info/deliveritdifferently-tiktok-challenge by 5pm AEST on Jan 21 2022.
Prize Claim Date: The Prize Winner must claim their prize by responding to the Direct Message by 5pm AEST on 16 January 2022. If the prize is not claimed by the Prize Claim Date, the prize will be forfeited and the Promoter may determine an alternative winner.
Re-Judging, Prize Winner Notification and Publication Details: In the event that the prize is not claimed by the Prize Claim date, or an entry is deemed invalid, or otherwise forfeited, the Promoter will re-judge entries to determine prize winners at 12pm AEST on 17 January 2022 at Level 35, Tower 3/300 Barangaroo Ave, Barangaroo, Sydney, NSW, 2000. The winner will be notified by Direct Message to their TikTok App account and their TikTok name will be published at https://www.menulog.com.au/info/deliveritdifferently-tiktok-challenge on the same date.
Winner Publicity: In accepting a Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter in relation to the Promotion. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their name, state, country and photographs without any payment being made to them in respect of this Promotion.
The Prize Winner will be responsible for ensuring they are able to accept the Prize as set out, including any expenses and arrangements involved in collecting and using the Prize, and in accordance with these terms and conditions. Prizes, or components of Prizes, are subject to availability and the Promoter reserves the right to substitute any Prize, or component of a Prize, with a Prize of equal or greater RRP value, subject to any written directions from a relevant regulatory authority. Winners will not be entitled to any additional compensation in the event that the Prize (or component thereof) has been substituted at equal or greater RRP value.
Section 7: General Conditions
Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.
Release: To the fullest extent permissible by law, each Entrant in the Promotion including without limitation the Prize Winners, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such Entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
Force Majeure: Subject to applicable law, the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter.
Disputes: These terms and conditions and any dispute or claim (including a non-contractual dispute or claim) arising out of or in connection with these terms and conditions shall be governed by the laws of New South Wales and subject to the non-exclusive jurisdiction of the courts of that State.
Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to Entrants and their representatives. This may include, but is not limited to, the names, email addresses, telephone numbers and other details provided by the Entrant on the registration form. The Entrant's and its representative’s personal information is collected so the Promoter is able to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and to publicise the Promotion. Use of content: By submitting an entry, each Entrant grants the Promoter a worldwide, non-exclusive, royalty-free licence (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such entry or any adaptation thereof (or any part of any such entry or of any such adaptation), in any and all media or distribution methods whether now known or later developed, without any restrictions and without any payment to the entrant or other consideration of any kind. Each Entrant irrevocably and unconditionally consents, as the author, to the fullest extent permitted by law (either present or future), to the Promoter (and its licensees, contractors, assignees and successors and their licensees, and any other person authorised by any of them):
