Easter Egg Hunt 2020 Terms and Conditions
Information on how to enter the Promotion forms part of these Terms and Conditions. Entries not made in accordance with these terms and conditions will be disqualified.
Section 1: Promotion
1. Promotion: Eligible Entrants who entered the competition will be selected by random to win 1 of 100 ‘$100 Menulog Gift Vouchers’, with a total prize value of AUD $10,000. These Terms and Conditions of Entry will be published on the Menulog website (www.menulog.com.au) and will be accessible in English.
2. Promoter: The promoter is Menulog Pty Ltd ABN 76 120 943 615 of Level 23, 227 Elizabeth Street, Sydney, NSW 2000, Australia.
3. Promotion Period: The Easter Hunt will commence 12.01pm on Friday 10 April 2020 AEST and will close at 11.59pm Monday 13 April 2020 AEST.
Section 2: Eligibility
4. Eligibility: Entry to the competition is open to all customers in Australia with a Menulog account. In the instance an Entrant is successful in winning the Prize, Entrants must have or create a Menulog account via www.menulog.com.au or the Menulog app in order to redeem the prize.
5. Non-Eligibility: The Entrant must not be an employee, manager, director of the Promoter, their related companies and agencies, and their immediate families.
6. Further, any missing or incorrect information or contact details provided on the entry form, or any subsequent cancellation of an entry before the conclusion of the promotion, will render that entry invalid.
Section 3: Entry to the Promotion
7. To enter, Entrants must order from at least one of the participating restaurant partners via the Menulog app, and add a comment in the order comments to indicate that they have identified one of the eggs or wish to participate in the competition. If an Entrant does not have a Menulog Account in order to enter the Promotion, the Entrant cannot progress with their submission. One entry will be counted for one Entrant, even if the Entrant ordered more than one menu item with the Easter egg symbol. If an Entrant places more than one order with one participating restaurant, one entry will be counted for that participating restaurant. If an Entrant places orders with more than one participating restaurant, one entry will be counted for each of the participating restaurants.
8. Entrants must complete the purchase process for entry. At the conclusion of the Promotional Period, all entries will be tallied by the Promoter in order to determine the winners of the Easter Promotion.
9. There are in total 100 participating restaurant partners in the Easter Hunt competition, 40 in NSW, 25 in VIC, 11 in QLD, 7 in ACT, 7 in WA and 10 in SA.
Section 4: Judging
10. Judging: 100 entries made by eligible Entrants will be selected as the winning entries by random draw conducted by a representative of the Promoter. The prize draw will take place at 10.00am AEST on Wednesday 15 April 2020 (‘Draw Date’) at Level 23, 227 Elizabeth Street, Sydney, NSW, 2000, Australia. This is a game of chance. One random draw will be conducted for each of the participating restaurants. A winner will be selected among the entries of that participating restaurant. The Promoter’s decision will be final and no correspondence will be entered into. Should there be no entries at any of the 100 participating restaurants, there will be no winner chosen at this location.
11. Prize Winners: The Prizes described below in Section 5 will be awarded to 100 winning Entrants only.
Section 5: Prizes
12. Prize Components: The Promotion offers 100 Prizes only. The Prize consists of a $100 Menulog Gift Voucher. The Promoter defines that this can be used for the Menulog website or app. Vouchers will be limited to Delivery orders only. Vouchers can be used in Credit or Debit card orders only, and cannot be used for cash orders. Vouchers will be provided to the Winners as codes to be entered into the Menulog checkout process. These codes will be listed against the date they are valid for within the 30 day period. Codes will be provided to the Winners the day following their acceptance of the prize.
13. Prize Value: Each Prize has a retail value of $100 inclusive of GST. The total retail value of the Prizes to be won is valued at AUD $10,000 inclusive of GST. Prize values are accurate as at the commencement of the promotion. The values of the Prizes in each state or territory are set out below:

14. Prize Conditions: The Prizes are subject to the following conditions:
- Terms of Use: By accepting the Prizes, Entrants agree to the Menulog Terms of Use: https://www.menulog.com.au/info/privacy-policy-and-terms-of-use. Vouchers are valid for 30 days.
- No exchange of Prize: Prizes will be supplied as described in these Terms and Conditions of Entry. The Prize can be transferred to another person or entity with approval of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and it does not wish to transfer the Prize, then the Prize will be forfeited;
- Taxes: Winners will be responsible for any tax liability associated with a Prize.
- If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu.
Section 6: Prize Winners
15. Contact: The Promoter will contact the Prize Winner in writing by email to the email address provided in the Prize Winner’s Menulog account within two (2) days of the draw to confirm their eligibility under these terms and conditions and to confirm whether the Prize Winners wish to claim their Prize. The Prize Winners’ names and details will be published on the Promoter’s website: www.menulog.com.au no later than 5.00PM AEST on the Draw Date Wednesday 15 April 2020.
16. Claim of Prize: Prizes must be claimed by no later than 10.00am AEST on Wednesday 15 July 2020. If the Prize Winners fail to do so by the deadline, the Prize Winners will be deemed to have forfeited their Prize. If there are any unclaimed or un-awarded Prizes due to ineligibility or other reasons, a Prize redraw will be conducted at 5.00pm AEST on Wednesday 15 July 2020 at the same location as the original draw.
17. Winner Publicity: In accepting a Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter in relation to the Promotion. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their name, state, country and photographs without any payment being made to them in respect of this Promotion.
Section 7: General Conditions
18. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.
19. Release: To the fullest extent permissible by law, each Entrant in the Promotion including without limitation the Prize Winners, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such Entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
20. Force Majeure: Subject to applicable law, the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter.
21. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.
22. Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to Entrants and their representatives. This may include, but is not limited to, the names, email addresses, telephone numbers and other details provided by the Entrant on the registration form. The Entrant's and its representative’s personal information is collected so the Promoter is able to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and to publicise the Promotion.
23. Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering this Promotion, unless otherwise advised by the Entrant or its representative, each Entrant and its representative consents to the retention and use of the information collected by the Promoter, which trades as Menulog. For details about who we are, how we may use your information and what your rights are under the new privacy laws, please see our Privacy Policy, which is available from the Promoter at www.menulog.com.au. Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Entrant or its representative, or distribution of marketing materials for goods or services in the food, technology and ecommerce industries from the Menulog Group.
